Resolution No. 2018-20

A RESOLUTION ACCEPTING TRANSFER OF JURISDICTION FOR CERTAIN PUBLIC ROAD SEGMENTS FROM HOOD RIVER COUNTY

The Hood River City Council makes the following findings:
WHEREAS, the Hood River Board of County Commissioners adopted and approved Order No. 18-003 on February 20, 2018 pursuant to ORS 373.270 offering to transfer to the City jurisdiction over portions of certain County road segments located on land that was recently annexed to the City of Hood River; and
WHEREAS, the specific roads segments offered for transfer to the City by Hood River County are portions of Belmont Drive, Park Place Loop, St. Charles Place Road, Brookside Drive, Westcliff Drive and Foster Court, more specifically illustrated in Exhibit A, attached hereto and incorporated herein by this reference; and
WHEREAS, pursuant to ORS 373.270, Hood River County’s offer to transfer jurisdiction for the road segments described in Exhibit A to the City of Hood River includes responsibility for the repair, construction, improvement and the levying and collection of assessments for these road segments; and
WHEREAS, the City Council considered Hood River County’s Order No. 18-003 at its regular meeting on December 10, 2018, prior to the expiration of the County’s offer of transfer.
NOW THEREFORE, BE IT RESOLVED by the Hood River City Council that, based on the foregoing findings and pursuant to ORS 373.270, the Hood River City Council hereby accepts jurisdiction from Hood River County for the public road segments offered in County Order 18-003 and illustrated Exhibit A, attached hereto and incorporated herein by this reference.  Full and absolute jurisdiction over these road segments for all purposes of repair, construction, improvement and the levying and collection of assessments therefor shall vest in the City of Hood River.  The City of Hood River shall have the same jurisdiction over these road segments as by its charter and the laws of the state are given or granted it over any of the public streets and alleys of the City.
IT IS SO RESOLVED, passed and effective this 10th day of December 2018, by the Hood River City Council.
