FOR THE CITY OF HOOD RIVER, OREGON

Resolution No. 2013-02

A Resolution repealing and replacing Resolution 2003-02 and Adopting
a Methodology Report for the Calculation and Imposition of Transportation System Development Charges and adopting a new Transportation SDC rate

 The Hood River City Council finds as follows:

 WHEREAS, ORS Chapter 223 authorizes cities to assess System Development Charges (SDCs) to finance capacity increasing system improvements needed to serve new development; and
 WHEREAS, the City of Hood River recently revised its SDC regulations and consolidated all such regulations into Chapter 12.07 of the Hood River Municipal Code addressing SDCs for transportation, sanitary sewer, water, stormwater and park systems; and
 WHEREAS, the City had previously addressed Transportation SDC regulations in Chapter 13.56, and the most recent Transportation SDC Methodology had been adopted in 2003 pursuant to Resolution No. 2003-02; and
 WHEREAS, the City’s transportation system is in need of certain capital improvements as identified in the City of Hood River Transportation System Plan, and there is a corresponding need to increase the City’s Transportation SDC rate through the adoption of a new Methodology; and
 WHEREAS, FCS Group prepared an up-dated Transportation SDC Methodology report (Methodology Report for Transportation System Development Charges, December 26, 2012), which proposes a revision to the Transportation SDC based on needed capital improvements to the City’s transportation system and proposes a rate based on the number of new Person Trip Ends that each new development and use generates; and
 WHEREAS, the City Council reviewed the Methodology Report for Transportation System Development Charges, a copy of which is attached as Exhibit A and incorporated herein by this reference; and

 WHEREAS, the City issued a 90-day Notice of System Development Charge modification as  required by ORS 223.304, and on August 20, 2012, the City sent mailed notice of the proposed revision to 47 parties who specifically requested such notice; and

WHEREAS, a 90-day Notice of System Development Charge modification was published in the Legal Notices section of the Hood River News on August 29, 2012; and

 WHEREAS, the Methodology Report for Transportation System Development Charges was available for review after September 1, 2012 at City Hall, 211 2nd Street, Hood River, and published on the City website at www.cityofhoodriver.com;
 WHEREAS, the City Council held a public hearing at its January 14, 2013 regular meeting, at which time it accepted a staff report and public testimony on the Methodology Report for Transportation System Development Charges; and

 WHEREAS, at the conclusion of the January 14th public hearing, the City Council deliberated and directed staff to prepare a resolution for the approval and adoption of the Methodology Report for Transportation System Development Charges to be considered and approved at the Council’s January 28, 2013 regular meeting.

 NOW, THEREFORE, based on the foregoing Findings, the Hood River City Council resolves that Resolution 2003-02 (A resolution modifying Transportation System Development Charges and related fees), adopted February 10, 2003 is hereby repealed and rescinded.

 BE IT FURTHER RESOLVED that Methodology Report for Transportation System Development Charges, dated December 26, 2012, attached hereto as Exhibit A and incorporated herein by this reference, is hereby adopted and approved as the basis for the calculation and assessment of Transportation System Development Charges for all new development in the City.
