Resolution 2009-52


(A resolution providing for the exemption of a public contract  with Claire Company for building plan review services)


WHEREAS, the City of Hood River is a municipal corporation in the State of Oregon (the “State”) and exists pursuant to the Constitution and laws of the State;

 WHEREAS, the City Council is the local contract review board for the City of Hood River;

WHEREAS, ORS 279B.085 allows the local contract review board to exempt certain public contracts or classes of public contracts from the requirements of competitive procurement contained in ORS Chapter 279B;

WHEREAS, the City Manager is requesting an exemption from the competitive contracting requirements for a public contract with Claire Company to provide building plan review services to the City.  The proposed compensation is 75% of building permit fees received and Claire Company’s agreement to employ the City’s Building Department employees to provide the services under the contract;
 WHEREAS, the City Council adopts the findings of fact in the attached Exhibit A in support of exempting the public contract from the competitive contracting requirements of the Oregon Public Contracting Code in accordance with this Resolution;


 NOW, THEREFORE, BE IT RESOLVED by the Hood River City Council that:

1. The public contract with Claire Company referenced above and in Exhibit A is exempt from the competitive contracting requirements of the Oregon Public Contracting Code.

2. The City Manager, Robert G. Francis, Jr., is hereby authorized to negotiate, enter into and execute a public contract with Claire Company to provide building plan review series to the City with compensation to Claire Company in the amount of 75% of building permit fees received by the City and to include Claire Company’s agreement to employ the City’s three Building Department employees to provide the services to be rendered under the contract, in form approved by the City Attorney.

Approved by the Hood River City Council the 14 day of December, 2009, to take effect immediately.
