ORDINANCE NO. 1973
(An ordinance amending Ordinance 1860—PacifiCorp franchise agreement extending the termination date by 120 days)
WHEREAS, pursuant to Ordinance 1860, the City of Hood River granted PacifiCorp, an Oregon corporation doing business as Pacific Power & Light Company, a non-exclusive electric utility franchise;
WHEREAS, Ordinance 1860 provided for a five year duration of the franchise granted to PacifiCorp and the five-year period ends on July 12, 2009;
WHEREAS, the City is in the process of considering a transition from a franchise arrangement for public utilities to a privilege tax arrangement for public utilities but has not yet adopted an ordinance so providing because City staff is working with the affected utilities to draft the ordinance;
WHEREAS, the new ordinance adopting the privilege arrangement would not be adopted or become effective prior July 12, 2009;
WHEREAS, PacifiCorp would be subject to the new ordinance enacting the privilege tax arrangement, but has requested an extension to facilitate its transition due to the July 12, 2009, expiration date;
WHEREAS, the City Council is willing to agree to a 120 day extension of the franchise agreement (Ordinance 1860) to facilitate the transition, or, if the privilege tax ordinance is not adopted, to enter into a new franchise agreement.
NOW, THEREFORE, THE CITY OF HOOD RIVER ORDAINS AS FOLLOWS:
The franchise granted pursuant to Ordinance 1860 is hereby extended for 120 days from the first day after the expiration date of July 12, 2009, to November 9, 2009.
Read for the first time: June 8th, 2009.
Read for the second time and passed: June 8th, 2009, to become effective July 13, 2009.
