(A resolution providing for terms and conditions for annexations under HRMC Section 12.09.030)
WHEREAS, Resolution 2005-12 establishes some terms and conditions applicable to property annexed into the City of Hood River and withdrawn from Ice Fountain Water District, Westside Fire Rural Fire Protection District and Farmers Irrigation District;
WHEREAS, Resolution 2005-12 was approved by the Council when it was the Council’s policy to only annex properties when the City could provide all services to the property;
WHEREAS, the Council has reconsidered that policy in light of the intergovernmental agreements between the City and the special districts to allow annexation without withdrawal from Ice Fountain Water District when it is not feasible for the City to extend water service to the property;
WHEREAS, the City intends to withdraw the properties in the future when it does become feasible to extend water service to such properties;
WHEREAS, property owners are required to compensate the City for the costs of withdrawal from special districts upon annexation; and
WHEREAS, the City Council desires to extend the requirement to compensate the City for the costs of withdrawal from special districts when withdrawal occurs after annexation.
NOW, THEREFORE, BE IT RESOLVED by the Hood River City Council that:
All annexations of property that is not being simultaneously withdrawn from Ice Fountain Water District shall contain a condition of approval requiring the property owner, and their heirs, successors and assigns, to compensate the City for the costs associated with the withdrawal of the subject property from Ice Fountain Water District pursuant to the City’s Intergovernmental Agreement with Ice Fountain Water District applicable to the withdrawal. The condition shall require the applicant to record a document in the deed records of Hood River County executed by the property owner binding the property owner and their heirs, successors and assigns to the obligation required by the condition required by this Resolution.
